My father has gifted his house to me, his younger son, by Gift Deed in 2013. My grandfather has given the house to my father by will and my father got probate in 1980. Can my elder brother revoke the Gift Deed claiming that it has been done forcefully by me? We are a Hindu family based in Kolkata.
Please note that for a valid transfer of property through gift, the gift deed has to be registered. Stamp duty also has to be paid on the gift deed. Once a gift deed is registered, the donar has no right to revoke the same unless specific provisions to that effect are made in the said gift deed.
As i can understand from the facts stated by you, the property transferred to you has been transferred to your father by your grandfather. Hence the said property is an ancestral property and hence you and all your siblings and mother have equal rights over the said property. The said property is thus not the personal property of your father and he has no rights to transfer the same via gift or will to you alone.
